Study On The Division Of Responsibility Of Children's Protection Subjects From Family Perspective

In recent years,child abuse cases have soared,and the issue of child protection has gradually come into people's attention,exposing the shortcomings of child protection in China.A review of child abuse cases in recent years shows that victims--children--only enter the public eye when they are severely abused or even killed.In fact,general domestic violence against children and incidents without serious consequences are still largely hidden.After children are abused,the government has no way to know and cannot intervene in the family.Even after serious consequences,the intervention is not perfect and there are many problems.China's child protection work has also made some progress.The Law on the Protection of Minors,the Anti-Domestic Violence Law and the General Principles of the Civil Law all regulate children's domestic violence.However,the problem is that each law does not specify how to identify whether a child has been subjected to domestic violence.It is not clearly stated how to deal with it after reporting the relevant departments.In the follow-up work on cases of domestic violence in recent years,it has also been found that the placement of children suffering from domestic violence has become a major loophole.Only children who have suffered great injuries will be taken away from their native families.In serious cases,parents' custody will be revoked,but the domestic violence that has not caused serious consequences will be placed in the government when the government intervenes.After the case is clear,is the child suitable for continuing to stay in the original family? How to assess the eligibility criteria for foster care or adoption if the child is fostered or adopted?Children are the future of the motherland.As a vulnerable group in the society,children should be taken care of by their families and protected by the society.The family is the core of child protection body and plays an indispensable role in child protection.Therefore,this article is to be with child of the family violence as theresearch object,examine perspective of family violence cases in the family in child protection problems of the main body,the function of the family in child protection work is missing,the government intervention of family orientation,interventional scale,way and subsequent placement problem,social problem for the problems existing in the family to provide services and help.Responsibility based on the analysis of the main problems on the basis of using the theory of multivariate main body participation,the government and society to participate,and services to help by providing system,reconstruction of family for the protection of children,or looking for a healthy and harmonious families in the home,the ultimate goal is to make the maltreated children return to family life,if not to return to a native family,also can live in a secure and harmonious families.With the family as the center,the government and society as the auxiliary to provide help and services for the family,realize the benign interaction and seamless connection among the three parties,and build a safe protection system and a sound abuse case handling system for children.This paper mainly uses literature analysis,historical analysis and comparative research to analyze the current situation and existing problems of children's protection in China,and introduces the child protection system in Australia,Japan and Sweden.At the same time,through the collection and reading of a large amount of literature,the major child abuse cases from 2011 to 2017 were compiled,and the reality and shortcomings of dealing with child abuse cases in China were found,and suggestions for improvement were further proposed..Based on the experience of Australia,Japan and Sweden,this paper proposes the future direction of child protection under the family perspective.At the family level,strengthen family responsibilities and expand social supervision.At the government level,clear government responsibilities,formulate intervention principles,ensure children's whereabouts,and properly resettle children.At the social level,we will raise social awareness and attach importance to child protection.
