Research On The Legislation Of The Protection Of Minors' Right Of Privacy On Internet In China

The concept of "Internet privacy" refers to the many rights that members of the society under the jurisdiction of a country have to ensure that their social rights and interests are not infringed.This includes the fact that members of society are protected against intentional or unintentional violations of their personal information.In today's Internet era,the issue of infringement of the right to privacy is emerging in the society.Because a large number of minors in the society have many immaturity in all aspects of physiology and psychology,it is also necessary to make due protection of their Internet privacy rights..A large number of developed countries and regions in Europe and the United States in this field of legislation and practice are very special,can provide reference to China.As of today,the legal system of our country in this field still exists such problems as low level and incomplete system.In order to solve this problem,to effectively protect the rights of minors and ensure the healthy development of the Internet,it is even more necessary to establish a series of related systems in this regard and improve the legal system for protecting the privacy of minors on the Internet.This article is divided into four parts.The first part is the basic problem of the protection of the minor's online privacy.Firstly,it defines the concept and content of the minor's online privacy protection,then introduces the characteristics of the minor's online privacy protection,and finally discusses the necessity of protecting the minor's online privacy protection.The second part is the current status of the legislation on the protection of the Internet privacy of minors in China.Although the relevant laws in our country are more and more complete,there is no relatively complete law on the protection of minors 'online privacy,and only some relevant regulations can be found in some normative documents.This reflects that our country to the minor network privacy protection degree still needs to raise;The third part introduces the relevant legislation of the Internet privacy protection of minors abroad,including some developed countries in Europe,America and Taiwan in China.The fourth part puts forward the legal countermeasures to improve the protection of the minor's Internet privacy,including the state-led management model and the self-regulatory management model of the industry.We hope to strengthen the protection of minors 'Internet privacy through relevant legislation,such as the formulation of a special law on the protection of minors' cyber security;Inclusion of the protection of minors 'Internet privacy in a special chapter of the Law on the Protection of Minors;In the Civil Code and the Criminal Code,the protection of the right to privacy of minors on the Internet has been strengthened.
