Research On The Examination Of Evidence Of Criminal Organizations Of Underworld Nature

With the transformation and development of China's society and economy,social contradictions have become increasingly prominent,and organized crime of underworld nature has also shown a trend of spread.Judging from our practical work,the tension between the demand and supply of evidence is particularly obvious in the examination and judgment of criminal evidence of underworld organizations,and the difficulty of obtaining evidence is also increasing.The article summarizes the collection and identification of evidence in criminal cases of underworld-like organizations,enriches the research on the evidence review of domestic criminal cases of underworld-like organizations,and provides reference and suggestions for the governance of criminal cases of underworld-like organizations in contemporary China.The first factor we should consider is the evidence.In the process of analyzing the evidence,we must focus on how to collect and apply the evidence,The organization's crime of underworld nature has the characteristics of long cycle,large number of personnel and wide area,so it is very difficult to obtain evidence.Therefore,it is necessary to set up corresponding evidence collection schemes and systems according to the characteristics of organized crime of underworld nature,which includes the collection of organizational evidence,criminal evidence and economic evidence,as well as the collection of harmful criminal evidence.The establishment of such systems is based on the characteristics of organized crime of underworld nature,and it is also to better punish the criminal suspects and defendants in such cases,which can also serve as a deterrent to the ordinary people in the society.The fundamental purpose of such systems is universal,that is,to ensure the smooth functioning of society and the well-being of the people.Based on this choice of value,this paper tries to study the evidence of the crime of underworld-like organizations,and discusses the characteristics of the evidence of underworld-like organizations in the academic circles,and draws a special way of collecting such evidence.After solving the problem of collecting evidence for crimescommitted by underworld-like organizations,this paper puts forward how to solve the problem of identifying evidence theoretically,how to prove crimes committed by underworld-like organizations through evidence in criminal judicial practice and how to guarantee the application of evidence concretely.It is hoped that this kind of research can provide benefits for theoretical research and judicial practice on this issue.
