The Study On The Investigation And Evidence Collection Of Underworld Organized Crime

In recent years,the crimes committed by the underworld organizations have shown many new changes and features in terms of criminal means,behaviors,and organizational structures,such as soft violence,routine loan,and the protective umbrella of mafia-like gangs and evil forces,which have caused great harm in the society.The campaign of cracking down on organized crime was deployed and conducted by the Party Central Committee and the State Council in January 2018.According to the deployment requirements of the Party Central Committee and the State Council,and in compliance with the requirements for the reform of the criminal procedural system centering on trials,the crackdown on criminal syndicates pursuant to law is currently one of the most important tasks for the public security organs.In this context,the author chooses it as the topic of this article to conduct a research by studying the characteristics of current criminal cases of the underworld organizations and the difficulties in investigating and obtaining evidence,and combining with the author's practical work to explore a targeted and feasible way of investigating and obtaining evidence.The thesis is divided into four parts.The first part is the introduction,which mainly states the background and significance of the research of underworld organized crime,and briefly introduces the current research status of underworld organized crime at home and abroad,as well as the research ideas and methods used in this article.The second part is an analysis on the basic theories of the underworld organized crime,mainly analyzing the concepts of underworld organizations and evil forces,and the difference between them.At the same time,it defines the concept of criminal cases of underworld organizations,and describes the features of current underworld organized crimes with the cases.The third part mainly analyzes the main difficulties and confusion in the investigation and evidence collection of the underworld organized crime under the background of the battles against organized crimes.The analysis is mainly based on the practical experience of handling such criminal cases in the author's work unit due to the particularity of the case and the limitation to finding relevant information.The fourth part illustrates how to find a practical way to solve the above problems in terms of enhancing ideological awareness,improving the measures of investigation and evidence collection,strengthening supervision of investigation and cooperation,setting up a high level investigation team,etc..Certain innovation of this article lies in closely combining with the practice and serving actual combat,focusing on the process of handling criminal cases of the underworld organizations,and exploring how to obtain evidence legally and reasonably,so that the public security organs as the main force can play the role better in the campaign of cracking down oncriminal syndicates.This article is hoped to provide a reference and help for the investigation and evidence collection at the front.
