Judicial Identification Of Underworld Organized Crime

The word gangdom originated from England at first,and the word Gangdom has been widely used.Gangland organized crime is called organized crime in foreign countries.As one of the three major crimes,Gangland organized crime seriously affects the stability of social order.At present,there is no gangdom organized crime in our country,and the Criminal Law of 1997 stipulates the gangdom organized crime for the first time.There are some inconsistencies in the determination of this crime by the judiciary in handling the case.How to reasonably determine the characteristics of the crime of mafia-style organizations,and whether the punishment of each actor belongs to the problem of repeated evaluation,the scope of criminal responsibility of the members of the main body of the organization and the degree of criminal responsibility,this paper takes the cases of Wang mou-xi and Niu mou-xian as examples respectively,the judicial cognizance of the organized crime of the nature of the underworld is further clarified.
