At present,China's e-commerce legislation has gradually evolved in the direction of improvement.When it comes to online overseas purchasing transactions,it still follows the legal provisions in the areas of civil legislation and tort liability law to resolve transaction disputes.Obviously there are some limitations and inadequacies in legislation.This article will proceed from the three aspects of the legislation,administrative supervision and social supervision of the network overseas purchasing agent market access,analyze the current situation and legal issues of the market access of our overseas purchasing agents,and put forward sound suggestions for the network overseas purchasing to create an orderly development environment.The body of this article is mainly divided into four parts:The first part outlines the related situation of market access of online overseas purchasing managers in China.This section first defines the concept and characteristics of the online overseas purchasing service that this article studies.Then,according to the different types of overseas purchasing services,the type of online overseas purchasing managers that this article regulates research is elicited in order to determine the market access of our overseas online shopping service managers.Determine the basic principles of market access for our overseas online purchasing service managers.The second part analyzes the current situation and problems of the market access of online overseas purchasing managers in China.This section summarizes China's current network of overseas purchasing managers through comprehensive analysis of China's current legal regulations,supervision,and judicial practice from the three aspects of China's online overseas purchasing business legal problems with market access legislation,administrative supervision,and social supervision.The third part refers to the extraterritorial market access experience from the three aspects of legislation,administrative supervision and social supervision.This section begins with the principled provisions of international organizations and China has signed a number of bilateral and multilateral agreements,and then learns from e-commerce to develop relevant experience in more developed countries,from the three aspects of legislation,administrative supervision and social supervision,from which to get the specification some inspiration and references from the market access of network overseas shopping agent managers in China.The fourth part proposes some suggestions for further regulating the market access of our overseas purchasing managers and solving related legal issues.This section mainly focuses on the conclusions of the first two parts of this paper,combining government departments,online trading platforms,social organizations,and other relevant aspects,and under the basic principle of market access for overseas purchasing managers in China,from multiple perspectives on China the network overseas purchasing agent market access proposes concrete suggestions for perfection,in order to build a more orderly and healthy network environment in our country.This article mainly adopts literature research and comparative research,aiming at the shortcomings in the current legislative norms and judicial practice in China,and fully understanding and studying the existing practices of international organizations and foreign countries,aiming at the current outstanding issues in China,in regulating online transactions.The overseas shopping service market access for managers in this field is a more practical and complete proposal to solve the legal problems that currently exist in overseas purchasing services.To standardize the market access for overseas buyers of online shopping malls in China can be more adapted to the arrival of the “Internet Plus” era,so that consumers can better enjoy the convenience of “no borders” and long-distance shopping,and facilitate the supervision of the administrative departments,while protecting the legitimate rights and interests of consumers at the same time.
