Urban underground space is a valuable natural resource and economic resource.As the urbanization process accelerates,limited land surface resources cannot meet the needs of urban expansion,which in turn creates a series of urban problems.With the development of social economy and the improvement of science and technology,the development and utilization of urban underground space has become an effective way to solve urban problems and achieve sustainable urban development.The development of underground space in Chinese cities has a certain scale,but the establishment,utilization,confirmation and registration of underground space rights are still in the preliminary exploration stage.So far,a complete set of underground space property rights system and property rights registration ideas have not been formed,which has seriously affected the city.The efficiency of the use of underground space.Taking the urban underground space as the research object,this paper first analyzes the origin,nature,connotation and composition of the underground space right,and determines the underground space rights system centered on the utilization of income.Then,based on the analysis of the necessity of registration,the construction is based on The underground space registration idea of the transaction,the underground space registration should be based on the principle of efficiency,determine the registration object,and organically connect with the ground,highlight the registration characteristics,and explore the underground space registration realization path,and finally verify the example of Nanjing Metro registration,the main research conclusion as below:(1)Ordinary land use rights are a three-dimensional concept,that is,the right to use the surface itself contains a reasonable space.The connotation of urban underground space does not include the reasonable adsorption of underground space attached to the transfer of ordinary land use rights.It is a specific spatial range outside the reasonable adsorption space.The specific space can be independently controlled and can generate income.(2)The urban underground space right is a bundle of rights,which can be characterized as usufructuary rights.The urban underground space property rights system should be compatible with the existing national land property rights system.From the actual use,it is considered that the urban underground space rights system includes three types:above ground-underground rights,independent underground rights,above ground-surface-underground rights,and underground space rights are There are differences in rights acquisition,price and use restrictions from surface rights.(3)Registration serves the market through rights disclosure and rights management.The transaction-based registration idea requires the principle of efficiency to be divided into registration objects;it is connected with the surface and highlights the characteristics of underground registration.The underground space registration is different from the two-dimensional plane registration in terms of the scope of rights,the contents of the records,and the expression of the book.To realize the three-dimensional expression of underground space registration,it is necessary to pay attention to the value of underground space,clarify the ownership of underground space,and accelerate the three-dimensional registration process.The subway can complete the registration of the right to use the construction land through the method of hierarchical registration and merger registration.
