Research On The Relativity Of Justice

Justice,usually for contemporary people,is a "calculating" personal virtue,so the social system of justice norms and justice system bases on this moral psychology also belongs to the "calculating" social system.Since it belongs to the elaborate social system,the object of this calculation can be divided into two categories: whether the concrete arrangement of a social system is fair from top to bottom,or whether people(mainly others from everyone's point of view)abide by the norms constituting the concrete arrangement of a social system from top to bottom.Assuming that these norms are generally fair,or are generally considered fair by us.Corresponding to these two phenomena,justice and injustice roughly refer to: justice refers to a society's institutional arrangements are fair or people have generally complied with this institutional arrangements,while injustice refers to a set of social norms itself is unfair or the social institutional arrangements have not been generally complied with.This paper mainly discusses the second sense of justice and injustice,that is,whether people's social system and social norms have been generally observed.This paper is divided into four parts.The first part is the basic theory of the relativity of justice,which is mainly divided into the relativity of justice "good" and the relativity of justice "make the best use of everything".Relative goodness of justice is mainly based on "relative goodwill".It writes goodness in justice and goodness in law,and makes the transformation from "relative goodwill" to "relative interest" and the contrast between them very distinct.The second part is the relativity of conditional justice.The meaning of conditional justice is that whether a person with a desire for justice can abide by the norm of justice in reality depends on whether others do the same.This part is divided into the subjective and objective conditions of justice,and the subjective and objective conditions of justice are analyzed.The subjective conditions of justice can be divided into the meanings of subjective conditions,conflicts of interests and good ideas,altruism and justice.The objective conditions of justice can be divided into the meaning of objective conditions and Hume's theory of the objective conditions of justice.The third part is the relativity of unconditional justice.The author divides this part into four aspects: the first is the relativity maintained by society;the second is the relativity and punishment;the third is the unconditional illusion;the fourth is the expression of my personal views,that is,the objective and subjective conditions of justice.I personally support the view of which scholar.The fourth part is the suggestions to improve the relativity of justice.This part is divided into the suggestions of perfecting the reciprocity of social maintenance and the suggestions of perfecting the relativity of justice by law.From these parts,we can get a general understanding of the problem of relativity,and hope that the views on the improvement of relativity in this paper can be recognized by everyone.
