Research On Peng Zhen's Rule Of Law

Peng Zhen has always served as an important leadership position in the Communist Party of China and national institution since the establishment of China.In leading and presiding over political and legal work,he persists in taking Marxism as a guide and works hard for China's socialist democracy and the rule of law by proceeding from the reality of China.According to Peng Zhen's works and the speeches of different periods,his thoughts can be divided into three periods: germination,development and maturity.Peng Zhen's thoughts about rule of law is based on facts and standardized by practice.The rich contents mainly include equality before the law,correctly handling the relationship between the party's leadership and judicial independence,correctly handling the relationship between the public,prosecutorial and legal organs,developing the People's Congress System,establishing and improving the system of primary level self-governance,reforming the legislative system,and strengthening the political and legal team.Since the Chinese 11 th CPC Central Committee Third Plenary Session,China's rule of law construction has achieved tremendous development,established the basic strategy of law-based governance,and formed a socialist legal system with Chinese characteristics.But it is not enough for meeting every requirement for fully advancing China's law-based governance.In the process of building the rule of law in China,there are still problems in the improvement of citizens' legal literacy,mainly reflected in the following aspects: unsound legislation,unfair law enforcement,unfair justice,and elections of primary level self-governance.Peng Zhen's law thought is the inheritance and development of Marxist theory.Studying Peng Zhen's law thought firstly can enrich and develop Marxist thought,secondly improve our national rule of law theory,then provide the guidance to the construction of rule of law in China.At present,under the guidance of Peng Zhen's thoughts about the rule of law,we should strive to cultivate citizens' legal awareness,increase the studying motivation of citizens' legal knowledge,and enhance citizens' legal application ability.We should further improve the legislation through the establishment,reform and abolition of the law.Guarantee law enforcement agencies to enforce the law in a strict,standardized and fair way,prevent the abuse of administrative discretion,standardize law enforcement procedures,and eliminate administrative inaction.Make steps to improve the electoral system of primary level self-governance,cultivate the legal awareness of villagers in accordance with law,improve the supervision mechanism of democratic elections,and resolutely tackle the corruption of primary level self-governance during the election.
