Research On The Balanced Distribution Of Responsibility And Power In The Reform Of National Supervision System

From 2016 until now,our country has selected the pilot supervision system reform in Zhejiang Shanxi and Beijing.《Constitutional amendment》and《The Supervision Law of the People’s Republic of China》were issued in 2018.The transference had been carried out in anti-corruption、anti-malfeasance and preventing corruption organs of all levels.The discipline inspection committee was set up and established throughout the country in all regions,provinces and counties,co-operatived work with discipline inspection,exercised the power of state supervision.The reform of supervision system has achieved phasic gains.With the deepening of the reform of supervision,there have been many issues to be resolved.Firstly,the establishment of related laws and regulations is far from keeping up with the supervision law,the exercise boundary of the supervisory power is smeared-out,the relief way to inspectors are lack;On the other hand,the division of responsibility and right boundaries among the discipline inspection commission、the National People’s Congress(NPC)and Judicial Office are not clear.So that the supervision of the supervisory power is weak.It’s put on the important agenda of NPC,CDIC and national supervisory commission to strengthen the construction of the supervision system and perfect the laws and regulations related to National Supervision Law.At the same time,the comprehensive and muti-dimension network of supervision and restriction should be formed by Superior Disciplinary Supervision Committee,NPC at the same level,judicial authority and public opinion,which guarantee that the supervisory power is exercised in accordance with Law and not abused.Improving the fault tolerance and fault rectification strategy and guarantee mechanism of supervisory organs and personnel during reform period can encourage people to take on responsibilities,and then the victories of fight against corruption and modernization of state governance systems and governance capacity will be realized.
