Study On The Legal Countermeasures Of Basic Pension Personal Accounts Vacancy In China

In China's annual two sessions,the reporters will inevitably refer to the problems of livelihood and old-age care issues,and also explicitly emphasize the need to further improve the employee pension insurance system and strengthen the regulations.Studying the root causes of empty accounts in China's basic pension personal accounts and the corresponding legal countermeasures is conducive to solving the pension payment dilemma,which is also conducive to the long-term stability of China's social order.This paper mainly uses comparative research,literature research and other research methods to analyze the legal problems existing in the development of China's basic pension personal account system.It is concluded that the appearance of personal accounts' empty is due to the flaws in its own system design and the unclear government positioning,irregular supervision and management,and the lack of supporting systems.Therefore,the relevant system should be improved as soon as possible to clarify the relationship between rights and obligations.Only when the workers feel the true ownership relationship can they encourage their enthusiasm for guarantee;establish the guiding position and protection role of the government,and upgrade the pension insurance's level to the national level;the post-supervisory management system should be strengthened,the responsible entities are clearly defined for fund management,supervision and investment,and mutual supervision should be established;the relevant supporting system should be established,a multi-level information platform should be established,the market system should be improved,and the capital investment should be diversified.
