Analysis And Reconstruction Of Notarization Functions In The Context Of Social Transformation

With the deepening of social transformation and the propulsion of notarization reform,new situations and problems have arisen in terms of design and functional orientation of the notary system.Both reform and development require strengthening basic theoretical research of notarization.This article responds to the new requirements of social transformation on notarization functions and the call for reform.The author combs the current development condition of research of China's notary system,and analyzes the current situation and the practical operational condition of the notary system.By borrowing insights from the Latin notary system,it discusses how to construct notarization functions in the context of social transformation,in the hope of better realizing the established value objectives and social goals of notarization,enabling notarization to serve China's economic and social development and to participate in the building of the rule-by-law country,and improving the rule-by-law level in China.This article is divided into four parts.Part One starts from the definition of notarization,compares notarization values,clarifies notarization functions,and locates the stages of notarization functions depending on the development process of notarization in China.In Part Two,the comparative approach is employed to compare the functions of the Latin notary system,and discusses the current condition of notarization functions' research in China.Part Three lists notarization functions' new situation and problems arising with social transformation,and thinks about the shortages existing in notarization functions and their root causes.Part Four takes legal sociology as theoretical basis,reconstructs the framework of notarization functions in the matter of social demands,and brings up the path from Ought-to-be to Is with regard to notarization functions.
