Study On The Examination System Of Judges In Nanjing National Government

After the Opium war,in order to save the country,the Qing government began to reform laws and initiated the modern Chinese judicial examination systems.In the second year of Xuantong(1910),the Qing government held the first judicial examination in modern China.Since then,the judicial examination system has been officially established in China.After the demise of the Qing government,the judicial examination system did not disappear,but was followed by the Beiyang government.Based on the judicial examination system of the Beiyang government,the judicial examination system of Nanjing national government has been fully developed and perfected.Based on the experience of previous generations,the Nanjing national government has constructed a complete system of the judicial examination system.The government has established an examination institution,which is specialized in examinations,and has introduced a series of judicial examinations laws to regulate the examination,the register,examination procedure,subjects,organization and management mode of the judicial examination.The national government has also set up a training institute for judges to train candidates in law practice.After the training,candidates must take the retest.Only those who pass the test can become judicial officials.Generally speaking,compared with the late Qing dynasty and the Beiyang government period,the judicial examination system of Nanjing national government period was more perfect,the examination content and procedure were improved,and the judicial examination law also formed its own system.However,there are some defects in the design and practice of this system,such as too broad examination qualification and too much interference with the normal examination order.Although there are great differences between the judicial examination system of Nanjing national government and the current legal professional qualification examination,its scientific examination mode,flexible subject design and training system closely connected with the examination are all worthy of our study and reference.
