| Sexual crime is one of the oldest crimes in the world.Victims of sexual crimes suffer from the most intimate and fundamentally dignified values ??of human beings.Compared with other criminal victims,sexual crime victims are more vulnerable and more likely to lead to prejudice in society.It is more vulnerable to secondary victimization in criminal proceedings,so special protection measures should be taken for victims of sexual crimes.Many countries and regions have adopted special protection for victims of sexual crimes that are different from victims of general crimes.However,China’s legislation on this issue is almost blank,and the degree of attention in judicial practice is extremely limited.This paper mainly takes the criminal law and criminal procedure law as the entry point,and proposes legislative proposals for the protection of the rights of victims of sexual crimes.This article is divided into four parts:The first part is an overview of the rights protection of victims of sexual crimes.It discusses the related concepts of “sexual crimes” and “the scope of victims of sexual crimes” and gives reasonable explanations for the special protection of victims of sexual crimes.The second part is to evaluate the results and shortcomings of the rights protection of victims of sexual crimes in China.The author believes that there are mainly the following problems in the rights of victims of sexual crimes: one is not clear,and the other is not comprehensive protection.The rights of victims of crime,the third is that there is no special regulation in the proceedings,and the fourth is that the conditions for victims of sexual crimes to obtain economic relief are severe.The fifth is the lack of reasonable regulation of media misconduct.The third part is the institutional observation of the protection of the rights of victims of extraterritorial sex crimes,and draws on the advanced experience of other countries.The fourth part is to make some suggestions on the improvement of the rights protection of victims of sexual crimes in China.It mainly includes thefollowing five points: one is to reorganize some of the crimes,the other is to comprehensively protect all victims of sexual crimes,and the third is to strengthen sexual crimes in the proceedings.The special protection of the victims,the fourth is to improve the economic relief of victims of sexual crimes,and the fifth is to improve the legal regulation of media speech. |
