Study On The Prevention Of Secondary Victimization On Chinese Rape Crime Victims

Sexual crimes infringe his or her sexual autonomy which is not allowed to be break and profane, and sexual crime victim always suffer the most intimate damage related to the value of their own dignity. Compared with other criminal victims, sexual crime victims are always subjected to longer and deeper impact on their minds. So the sexual crime victims should be given more attention and protection. However, in fact, sex crime victims in actual life sustain many other difficulties outside of criminal violations, due to various objective factors, such as pressure coming from other people’s eyes, reports causing the victim’s privacy exposure to the outside world and the judiciary staff misconduct, which all have caused the victims’psychological burden lead them to the formation of "secondary victims". In our country the concept of personality is very traditional and conservative, hence compared with other types of crime victims, the situation of sexual crime victims is particularly difficult. Therefore giving them special protection in respective of the law and practice is substantially helpful for their recover and returning to society. At present, the specialized legislation for sexual crime victims is still blank, and we are lack of attention to victims’secondary victimization. Based on the above background, via drawing and absorbing experience from the Hong Kong, Taiwan and foreign legislation this paper elaborates the preventive measures of secondary victimization on sexual crime victims from three aspects. The first part of the article analyses the construction of preventing secondary victimization on the basis of clarifying the meaning of the second victimization, and we also state the reasons of suffering the secondary victimization. The second part of this article states concrete measures on national legislation and the judicial system for preventing secondary victimization in China. The third part, in the perspective of social response to the victim’s, it analyzes and expounds the system of social assistance give special attention and rescue for sexual crime victims.
