Research On Victims Of Homicide Crimes In Family Disputes In China

In recent years,there were frequent cases of intentional homicides caused by family disputes in China,such as the case of second rich generation's wife-killing case in Nanjing,the annihilation case in Daxing,Beijing and Zhu Xiaodong's wifekilling case in Shanghai.These cases stimulated people's nerves and challenged the bottom line of ethics.These cases always attracted people's attention,and the academic community also conducted extensive discussions on them,but the discussions were mainly focused on the offenders and the causes of the crimes,but usually the victims were ignored,who were also an important group.Due to the complexity of internal contradictions in family disputes and the special relationship between the victims and the offenders,some crimes were induced or promoted by the victims themselves.Therefore,the victims played indispensable roleroles in such crimes.Hence,the author believes that the study of victims of family would be helpful for reducing the vicious transfromations of family conflicts.Therefore,the author screened 248 cases of intentional homicide in family disputes through the Chinese refereeing documents network,and analyzed the status quo,the victim characteristics and the victimization of such crimes through statistical methods,proposing feasible and effective prevention measures against the above mentioned peculiarities.This paper is divided into four parts.The first part is the analysis of the current situation of homicide crimes in family disputes.By analyzing the data of 248 judgments,it is found that such crimes have many features,for example,most of the cases occurred in the southwest of China,during the night hours and infamily houses as the main crime sites.According to the relationship between the victims and the offenders,the victims of the crimes can be divided by the relationship of husband and wife,parent and child and brother and sister.The peculiarities of the victims are high female victimization rate,mainly middle-aged and older people,low education level and high mortality rate.The second part is the analysis of the relationship between the victims and the offenders in the murder crimes of family disputes.Through the interaction performance and the mode of the two parties in the process of victimization,and whether the changing of the roles,the author analyses the characteristics of the victims longitudinally.It is found that in this type of crimes,the offenders adopted the active attack mode,and thevictims promoteed the crime.When the two parties have a fierce conflict,the role cannot be distinguished,and the evil inversion might occur.The third part is the victimization analysis of homicides of family crimesby enumerating the factors of the victims that related to the crimes,and analyzing the negative marriage environment and the negative factors in the social environment.It is found that the victim's own inducibility,acceptability,fault,disloyalty to marriage,misguided teaching to children,economic pressure and other factors will become the factors for family crimes to commit crimes.Through the above-mentioned deep analysis of such crimes,the fourth part proposes targeted prevention and control measures for homicide crimes of family disputes from three aspects: the individual,the family and the society.The author presents the measures with a view for enhancing the prevention awareness of potential victims,reducing criminal opportunities and strengthening community supervision to reduce the incidence of homicide crimes within the family.
