| Legal aid refers to the legal aid system that provides the parties suffering financial difficulties or of special types with fee exemptions.According to different objects of assistance,it can be divided into legal aid for criminal suspects,defendants and victims.The paper mainly studies the legal aid system of victims of sexual crimes which is one of the special victims.If the victims of sexual crimes are not in a safe environment,they are vulnerable to secondary injury once they recall sexual assault on memory every time,and if there is no lawyer present,the degree of injury may be greater.The promotion of legal aid to the victims of sexual crimes can not only effectively prevent the victims of sexual crimes from being victimized again in the criminal procedure,but also more effectively protect their rights and interests,which to a certain extent shows the level of national legal construction.Currently,China’s legal aid system for victims of sexual crimes is in the dilemma,including insufficient understanding of its necessity,weak pertinence,lack of norms,disorder,lack of rights,lack of funds and so on.Compared with China,the government of South Korea has provided special provisions and relevant guarantees for the legal aid system of victims of sexual crimes.The government of South Korea provides unconditional legal aid system for victims of sexual crimes,enabling the special group to receive special protection.Since China and South Korea have different criminal justice concepts and different litigation systems,their provisions on legal aid of victims differ.The legal aid system for victims of sexual crimes in South Korea is also known as the " Public Defender System for Crime Victims”.All victims of sexual crimes and abused children in South Korea can get the help through the " Public Defender System for Crime Victims".In China,there are economic difficulties and other restrictive conditions for victims of sexual crimes to obtain legal aid.However,in South Korea,it is less difficult for victims of sexual crimes to obtain legal aid.In case of no lawyer for victims of sexual crimes,the South Korean prosecutors can select the Public Defender for Crime Victims for legal aid.The Public Defender for Victims of sexual crimes in South Korea can be used for reference in improving the legal aid for victims of sexual crimes in China.Measures shall be taken to analyze the difficulties existing in the legal aid system for victims of sexual crimes in China,combine the beneficial experience of South Korea and the national conditions of China,and gradually formulate,modify and improve the relevant norms,measures as well as supporting systems from the aspects of entities and procedures,so as to comprehensively protect victims of sexual crimes and significantly improve the status of victims of sexual crimes in criminal procedures. |
