Research On The Law Enforcement System Of Prevention And Control Of Domestic Violence In Public Security Organs Of China

Domestic violence is a serious violation of citizens’ personal rights,which will seriously affect family harmony and social stability.The attitude of our government towards domestic violence is zero tolerance.In March 2016,China promulgated the Anti-Domestic Violence Law of the People’s Republic of China,which broke the dilemma of lacking special laws to deal with domestic violence.This law provides a legal basis for law enforcement personnel to intervene in the handling of domestic violence cases,especially for the public security organs to play their own functions,timely handling of domestic violence cases and the resulting criminal cases,and safeguarding social security and stability.At present,the legal system of prevention and control of domestic violence by public security organs in our country needs to be improved urgently.There is still a long way to go for public security organs in our country to prevent and control domestic violence.The entry point of this paper is to improve the law enforcement system of prevention and control of domestic violence by public security organs in our country.This paper is based on the study of the current anti-domestic violence laws and regulations of the public security organs in China,the research results of many domestic scholars,and the actual practice of the police in the United States,Britain,Hong Kong and Taiwan in dealing with domestic violence cases.This paper makes an analysis of the current situation of legislation on the prevention and control of domestic violence by public security organs in China,and at the same time analyses the responsibilities and main functions of public security organs in preventing and controlling domestic violence in China and in-depth analysis of the law enforcement dilemma affecting the prevention and control of domestic violence in China’s public security organs.For example,the particularity of domestic violence itself,the ignorance of domestic violence by the public under the traditional thought of our country,and the obstruction to the prevention and control of domestic violence brought by the public opinion which questioned the intervention of public power in domestic violence.Due to the lack of special institutions and performance appraisal system to prevent and control domestic violence in public security organs,insufficient attention has been paid to domestic violence by the police,and the challenge of the credibility of public security organs in dealing with domestic violence law enforcement brought about by single and inefficient handling methods.This paper makes a concrete study and comparison of the special laws,regulations and specific practices on which the police in Hong Kong and Taiwan are based in dealing with domestic violence cases,and analyses the experience and enlightenment that the police in mainland China can learn from them on how to prevent and control domestic violence.At last,this paper comprehensively and meticulously puts forward specific ways and measures that can be perfected by the public security organs in the law enforcement system of preventing and controlling domestic violence,and analyses the reasons,and puts forward its own suggestions for the law enforcement system of preventing and controlling domestic violence of the public security organs in our country.
