Empirical Research On The Prevention And Treatment Of Domestic Violence By Public Security Agencies

Domestic violence is a worldwide common social problems,it not only brings great pain to individuals,families,but also all sorts of negative influence to the society.As a result,more and more countries regulate the problem with the system construction.With the rapid development of our country's anti-domestic violence legislative construction,the first law of of "anti-domestic abuse of the People's Republic of China" has been carried out formally since March 1,2016,which has the great significance to the progress of anti-domestic violence research.But at the same time,relevant legislation matching the "anti-domestic violence law" and supporting measures need to be improved and perfected.In particular,the public security organas an important part of enforcement process,still lacks of specific legal regulation for the prevention and control of domestic violence work.In view of this,the author hope to know about the public security organs,the first line of police on the problem of domestic violence prevention,whose basic cognitive and practical approach.In this way,we want to analyze the causes of the problems in the work,so as to explore the effective pathway to strengthen the public security organ prevention and solve domestic violence effectively.There are five parts except the preface in this paper.The first part:The theoretical basis of domestic violence prevention and treatment of the public security organ.Introducing the legal basis and analyzing of and legal regulation respectively.thereby laying a foundation for the empirical research.The second part:The reliability of research plan and its basic information,including the research scope,research methods and research samples.The third part:The analysis of researching results.We start from the public security organs of the basic knowledge of the domestic violence act,the police awareness of their legal responsibilities and functional construction of the domestic violence prevention and treatment.Thus,it will contribute to making clear the distance between the reality and ought to be,providing practical reference for analyzing and solving the problems.The fourth part:The analysis of problems and causes.Firstly,introducing the problems existed,mainly including the police own existence psychological misconceptions,lack of enthusiasm,unclear understanding of their duties,lack of related institutional allocations;Secondly,analyzing causes of this situation,mainly including the tolerance of deep-rooted culture for domestic violence,rewards and punishment mechanism is not perfect,the lack of definite execution rules,anti-domestic abuse work against a marginalization.The five part:The prospect of prevention and control of domestic violence for the public security organ.Mainly including strengthening the construction of ideological level;Working out detailed rules for the implementation,strengthening the operability;Perfecting performance appraisal system,regulations of the public security organ to deal with the responsibility of the domestic violence cases and procedures,establishing a mechanism for grading;Strengthening related configuration,anti-domestic violence professional institutions and professional personnel,Improving work efficiency.
