An Empirical Study On Prevention And Treatment Of Domestic Violence In Rural Areas

Domestic violence,as a serious social problem,has received wide attention in the world.China’s anti-domestic violence legislation has also been exploring progress.The"People’s Republic of China anti-domestic violence law"which was implemented since March 1,2016,has prompted China anti-domestic violence to a new step.In the aspect of the rural domestic violence,the law clearly stipulates the village committee as one of anti-domestic violence subjects,and it is in the position of assistance and coordination in the work of anti-domestic violence.The village committee is bridging the gap between other anti-domestic violence subjects and domestic violence in rural areas,and is the bridgehead of the wok in prevention and control of rural domestic violence.However,for more than two years,domestic violence in rural areas happens still frequently.For suppressing to domestic violence,reducing the harm of domestic violence in rural areas,I choose the village committee as the angle of view and beginning the empirical research about the rural domestic violence.My purpose is to know the current situation of the domestic violence in rural areas and the situation about the village committee’s duty and to explore the new path for the wok in prevention and control of rural domestic violence.There are four parts except the foreword in this paper:The first part is the feasibility analysis of village committee intervention in rural domestic violence.This part discusses the feasibility of village committee intervention in rural domestic violence from the perspective of the village committee as the legal basis of anti-domestic violence and the unique advantages of the village committee in the prevention and control of rural domestic violence.The second part,case investigation and analysis.First,this paper introduces the basic situation of empirical research,includes research methods,scope and sample.Second,I sum up the characteristics of the rural domestic violence:concealed appearance,open inside;bad habits is multiple incentives;mediation and private relief is the main way of relief;more occured between husband and wife,women are the majority and the physical in.jury is prominent.Third,combining the research data to analyze the performance of the village committee in the domestic violence prevention work,and the status of rural married women suffering from domestic violence were analyzed.The third part is the plight and causes of the village committee in the prevention and control of domestic violence.First,analyzes three major difficulties are faced by the work about prevention and control of rural family violence:The law of learning problems,responsibility consciousness is not strong;the lack of control mechanism,and other main functions of anti-domestic violence cohesion are insufficient;behind the building,the absence of anti-domestic violence.Secondly,explore the deep-seated causes of difficulties lies in law propaganda and the absence of study;the grass-roots work is dominated by the center of gravity and anti domestic violence is"marginalised";lack of the power and responsibility mechanism in legislation and guidelines in work;limited number of village committee members and lack of funds to anti-domestic violence.The fourth part is put forward the prevention and control of domestic violence in rural areas.Put forward the following suggestions combine with the characteristics of the rural area:one is to construct the village committee as the core of the rural family violence prevention and control mechanism,including:prevention and early warning mechanism,emergency disposal mechanism and post supervision mechanism;one is to classify domestic violence and perfect the linking mechanism of anti-domestic violence subject.one is the legislation perfect accountability mechanism prevention and control work domestic violence in rural areas,including clear legal responsibility and procedural norms in two aspects;and one is the government should to actively play the leading role in the work of prevention and control the rural domestic violence;the other one is to strengthen the legal work,improve citizen awareness of individual rights.
