Research On The Supervision And Coverage Of Public Servants Of Democratic Parties——From The Perspective Of The Supervision Law

The first paragraph of Article 15 of the Supervision Law stipulates that the public officials of the democratic parties are one of the targets of supervision,but they have not stipulated the standards and scope for the identification of public officials of the democratic parties.Moreover,the academic circles have less research on the reasons,dilemmas and solutions for monitoring the public officials of the democratic parties,and the theoretical support for the further development of the supervision is weak.Affected by the above two issues,the work of the Democratic Party's public officials to be included in the supervision is facing challenges.In order to define the scope of the public officials of the democratic parties,analyze the reasons for the supervision and the dilemma we are facing,and propose a path to solve the dilemma and reference,This passage compare the theory about the definition of public officials with the legal provisions on public officials at home and abroad by adopting the comparative analysis method and the empirical analysis method,it's believed that the determination of public officials in China should be based on whether exercise public power or not.At the same time,according to the studies of the status of supervision of public officials of democratic parties and the supervision documents of inside and outside the party,this paper makes a preliminary monitoring path which is scoped,principled and methodical.This is to say when monitoring the public officials of the democratic parties,we should pay attention to the differences between party behavior,political power behavior and public office behavior,adhere to the principle of supervising with scope and respecting the autonomy of democratic parties,and carry out ideological convergence.We should carry out ideological cohesion,the cohesion of inner-party supervision regulations and supervision law,procedure cohesion and organizational structure cohesion,and use detention measures cautiously.
