Research On Problems And Solution Of Economic Dismissal System Of Enterprises

In China,the economic cuts refers to enterprises dismissing redundant workers in batches in order to overcome operational difficulties,belonging to the non-negligent fired in a broad sense.Practices show/ Practice has proved that,in China,economic dismissal system has outstanding problems in layoff economic conditions,procedures,supervision,relief & compensation and many other aspects.In the context of today's/current domestic economic conditions,which are brewing the demand of cuts,our economic dismissal system should be improved on the basis of considering China's specific national conditions and borrowing foreign economic cuts legislation practices.Meantime,insisting on giving full respect for the freedom of enterprise management and protecting workers' rights,especially vulnerable workers 'rights.In the recognition of economic reasons,we should relaxed the restricted conditions to fully respect enterprises rights of layoffs that's implemented on the reason of difficult operational and combined with practical problems and serious reasons,to permit cuts result from financial reasons.In procedure,different procedure rules should be established base on different scale of staff reduction.For example,small and medium-sized enterprise cuts can follow the record review system.The large-scale cuts must abide by the stringent procedures of notification,consultation,record,etc.The special cuts(such as re-habilitation)should be ruled by the court.In supervision and relief,the Labor Administrative Department should perform their functions of supervision,organization,coordination.The Labor Arbitration Committee should provide professional assistance to settle labor disputes.In addition,it also demands to encourage,support,supervise and urge the development of the labor union and its functions performed,and to strengthen the protection for the handicapped,aged,pregnant and other vulnerable group.
