Study On The Legalization Of Private Security Military Company And Its Ways

PMSC have been associated with various crimes and scandals since their inception,bringing a series of problems and controversies.But it is undeniable that it has many advantages.It should be put on the right track instead of being suppressed.Compared with foreign PMSC,China's security companies are simple and weak.However,as China's overseas risks intensify,China's security companies have begun to conduct business overseas.The experiences and lessons of the international community regulating PMSC can be used as reference for China's security companies.Thus the first part of this paper first analyzes the development status of PMSC,and then discusses the legalization dilemmas it faces,including its unclear legal status,unable to take responsibility and jurisdictional difficulties.Although there are many problems,considering the current influence and the self-advantage of PMSC,it has the necessity of legalization.Therefore,the second part mainly discusses the necessity of its legalization.Since PMSC needs to be legalized,can it really be legalized through relevant legislation? The author in the third part,through examining relevant international legislation and relevant domestic legislation,believes that the international community supports its legalization and domestically,such as the United States,South Africa and other countries have legalized this industry.In view of the necessity and feasibility of its legalization,the fourth part discusses the measures of its legalization.One is to promote the legal construction of PMSC at the international level,and the other is to strengthen the self-discipline of the industry.After analyzing the legalization of PMSC in the international level,the author turns his attention to China.China's security companies can legally practice in China,but once they step out of national borders,can it still legally practice? Domestic law does not provide for this.Therefore,the last part mainly discusses the legal dilemma faced by China's security companies in overseas development,the necessity and feasibility of its legalization in overseas development,and its legalization ways.
