Study On The Online Filing System In The United States

In recent years,the courts of all over the country have carried out the practice of filing cases online,and there are many difficulties and shortcomings based on great progress and certain achievements.Looking at the online filing in other countries and regions of the world,the online filing system in the US has been built earlier and is more and more mature.Therefore,the experience gained in the practice of online filing is worth learning from.At present scholars' researches in our country about the United States online filing are not comprehensive or in-depth issues which date is too old.In view of this,this thesis tries to give a research about the online filing system in the US with literature research,historical analysis and comparative analysis of research methods;at the same time provides another way of thinking and vision for the development of China's online filing system.The fundamental reason for the launch of the online filing system in the United States is that the American legal profession hopes to solve the litigation problem of "litigation explosion" through the network electronic technology,and the direct reason is to solve the large number of filing cases of the Federal District Court in northern Ohio in 1996.In the more than 20 years since its launch,the online filing system in the United States has been continuously developed and mature in terms of laws,applicable courts and system functions,and has grown into a comprehensive filing system.The online filing system in the US is mainly carried out through the Case Management/Electronic Case File System and Public Access to Court Electronic Records System.There are differences in the filing process of different courts.The United States online filing overall success just like full recognition of all the parties,reducing the cost of justice,improving litigation efficiency,improving the openness and transparency of the case,but the system also has some problems like specific rules are not unified,the system is too complex,the public questioned the existence of system charges etc..China's online filing system has made significant progress after years of development.However,there are still some problems and shortcomings such as the prosecution limitation,unbalanced regional development,simple implementing way of online filing,and divided standards of online filing.Focused on the difficulties and problems of online filing in China,China can draw lessons from the successful experience of the United States in many aspects such as legislation,ways of establishment,implementation mode,training popularization and other systems,so as to build and carry out online registration system.
