Research On China's Online Filing System

Online filing refers to a new type of filing method that combines the Internet with the Internet on the basis of the traditional filing.The online filing system refers to a collection of a series of legal rules formed around the Internet.The establishment of an online filing system is more conducive to the promotion and implementation of online filing.The emergence of online filing and the formation of the online filing system have promoted the process of informatization construction of the courts in China,facilitated the litigation behavior of the parties,and improved the efficiency of the court.As the online filing system continues to develop,problems continue to emerge.There is a lack of definition of the basic concepts and legal basis in theory.In practice,there is a lack of uniform normative standards and safeguard mechanisms for online filing materials.In order to solve the problems in the online filing system,promote the development of the online filing system,and fully implement the online filing system.This paper takes the online filing system as the research object.Firstly,based on the theory,it uses the literature research method and the concept comparison method to clarify the concept of online filing and system,and analyze its characteristics and value pursuit.Secondly,from the practical exploration,using empirical research andcomparative analysis,through the analysis of the status quo of the online representation of the five representative local courts,explore the problems existing in the practice of the online filing system,that is,there is no legal basis,local standards are different,The concept of online filing is confusing and the material preservation mechanism is lacking.Then,we will learn from the US online filing system to carry out institutional innovation.Finally,from the three levels of rules,operations,and ideas,we will improve the online filing system in China.The aim is to promote the development and implementation of China's online filing system,so that the online filing system can truly facilitate the parties and improve the efficiency of the court work.
