Research On The Problems Related To The Personal Injury Relief Of The Prisoners

As a group of people who accept criminal punishment,the protection of their personal rights is often neglected,and the lag of the relevant prison legal system is becoming increasingly apparent.In our law notwithstanding the provisions on the protection of the rights of prisoners,but in theory and traditional culture,the institutional guarantee of prisoners rights relief missing,lead to rights,but it is difficult to achieve.In the current prison judicial administration practice,this problem has become increasingly prominent.The relevant laws and regulations are not clear enough,the operability is not strong,divorced from reality.In the process of dealing with related problems,there are many serious problems,such as weak theory,unclear policy,different standards,lack of relief and so on,which caused great confusion and greatly affected the normal development of prison work.The relief of the personal right damage of prisoners can not only guarantee the realization of private rights,but also promote the impartial execution of prisons,and also the need to realize procedural justice.This study will take the typical case of compensation for personal rights injury of prisoners as the breakthrough point,in-depth analysis of the current prisoners' personal rights relief,compensation system of various drawbacks.We should from change idea,perfecting legislation,establishing the prisoner litigation right,provisions of the administrative appeal system,establish comprehensive supervision system of prison,inmates and other social insurance coverage system,gradually improve China's prisoners personal rights relief system.
