Study On The Construction Of Complaint Handling Mechanism Of Prisoners In Modern Prison View

Along with the socialism rule of law reform process unceasing advancement,and the constant improvement of the people's legal consciousness,the protection of the lawful rights and interests of persons serving sentences in the prison is receiving more and more attention from the society.In particular,in the constitutional amendment of 2004,it's the first time that "respect and protection of human rights by the State" has been written into the fundamental law of the country,which guaranteed the human rights of citizens(including prisoners)at the constitutional level.As a"disadvantaged group",persons serving sentences are in a special state corupulsory relationship,and their rights are more vulnerable to infringement.As a result,on how to pay equal attention to punishment and reform in prison law enforcement,how to protect the human rights of persons serving sentences in the prison,especially the relief of the right of complain to persons serving sentences,it's studied and analyzed in this paper.At present,it is more and more urgent,epochal and realistic.Based on the comparative analysis of domestic and foreign handling complaint mechanisms and combination of empirical investigation,this paper combs out the problems existing in the complaints and relief of persons serving sentences in the prison in our country,and also puts forward suggestions on how to build a complaint handling mechanism from perfecting the legislative foundation,standardizing the procedure design,perfecting the inspection and supervision,unimpeded judicial relief,and strengthening human rights education in which the procedure design for handling complaints should focus on resolving the neutrality of the subject receiving the complaint,the singularity of the complaint channel,and the delay in handling the feedback and unclear protection of appeal and so on.
