Research On Legal Protection Of The Rights And Interests Of Bank Cardholders

At present,the financial market is flourishing day by day.As the most important settlement tool of financial industry,bank card plays an indispensable role in economic activities.Although China has established a relatively perfect system to promote the development of banks,it neglects the protection of the rights and interests of cardholders.Most developed countries in foreign financial industry have established a perfect system to protect the rights and interests of cardholders.It is of great significance to improve the banking business norms and strengthen the legal protection of cardholders rights and interests in order to promote the development of China's banking industry and even the whole financial industry.Based on the inclined protection of the rights and interests of bank cardholders,this paper explores the current situation and existing problems of legal protection of the rights and interests of cardholders in China,and puts forward some countermeasures to improve the protection of the rights and interests of cardholders.Firstly,it analyses the legal relationship between the main body and the main body of the bank card business,lists the specific rights and interests of the cardholder,and analyses the value of protecting the rights and interests of the cardholder from the perspective of the bank and the cardholder respectively.Secondly,it combs the laws and regulations of protecting the rights and interests of the cardholder in China,and reflects the specific manifestations of the violation of the rights and interests of the cardholder through appropriate cases,combining with this paper summarizes the current situation and tort manifestations of the legal protection of cardholders rights and interests in China,such as the absence of basic legislation,the unfairness of format clauses,and the unclear principle of imputation.Finally,through the investigation and analysis of the legal protection system of cardholders' rights and interests in Britain and the United States,we can extract the system worth learning from,based on our country's reality,combined with our research.As a result,the urgent problems to be solved in our country are put forward from the aspects of perfecting legislation,regulating standard contract,defining the principle of liability,perfecting the supervision system and perfecting the mechanism of safeguarding rights.
