Study On The Evolution Of EU Personal Data Cross-border Transfer Rules And Its Implications For China

With the digital age and information era ushering in,the dual attributes of personal data— personality and economic value are in sharp conflicts.In consideration of the strategic significance of personal data cross-border transfer rules,many countries begin to attach great importance to the legislation of data rights.Among those legislation practices,EU takes a dominant and leading place.The EU General Data Protection Regulation which is about to take effect within two months,has raised worldwide attention and concern because of its overwhelming extraterritorial influence,unparalleled strictness and intensive scope,which is epitomized in its personal data cross-border transfer rules.This article endeavors to dig into the contents and scope of EU personal data cross-border transfer rules,the relative legal mechanisms and controversial legal issues,from the perspective of the provisions of law,court's juridical practices as well as the law enforcement activities of Data Protection Authorities.On the basis of intensive template study and analysis,this article attempts to provide pertinent and practical suggestions and implications for legislation activities in China.
