Foreigners' Commission Of Crime In China And Judicial Countermeasures

With the faster speed of China's opening its door to the outside world and urban internationalization,foreigners increase in number in China.The frequent movement of peoples brings about not only economic development but also growth of foreigner-involved cases,the latter leads to public worry about and attention to foreigners' commission of crime in the country.The problem of foreigners' commission of crime which has puzzled western developed countries for a long time has appeared in China,which first challenges such economically developed cities as Beijing,Shanghai and Guangzhou.With the new criminal procedure law amended,first-line police agencies and people's procuratorates concerned have jurisdiction over copingwith foreigner-involved crime.However,owing to the lack of experience and detailed rules on handling foreigner-involved criminal case,this paper collects and rearranges main problems concerning such cases and suggests corresponding judicial countermeasures,which the writer hopes can provide reference for our counterparts in handling such cases,improve case-handling quality and protect the litigation right of foreign criminal suspects,who enjoy national treatment.This paper has three chapters,the first of which starts with the description of present state of foreigners' commission of crime in China in recent years,analyzes the situation,characteristics,trend and causes by the means of collected data.The second narrates the main problems.The third suggests corresponding judicial countermeasures targeting the problems mentioned above.
