Replacement blood donation was one of the emergent supplementary blood donation models of our county.At the beginning of the legislation,considering the background,together with citizens' awareness of blood donation,and response to clinical shortage of usable blood,the "blood donation law of People's Republic of China"(referred to “blood donation law”)Article XV validated the replacement blood donation to protect the blood supply.The "Blood Donation Law" was the first national law on blood donation in our country.Subsequently our Country also issued "medical blood for clinical management approach" and "clinical blood transfusion technical specifications".However,those guidelines set up terms for replacement blood donation,but there were no enough clarification and application details.There were some trouble and confusion for local specificimplementation.The patient-specific mutual replacement blood donation had become a priority beneficiary.Although there was no national legislation to clarify,it became a legal way for patients to receive blood.It gave space for paid blood donation,and even delivered illegal social issues.Therefore,the current thesis mainly focused to discuss the quality of blood and social problems generated from replacement blood donation.After review the current legislative status,we discussed those potential defects of replacement blood donation,and the source of the problems from the side of both blood donors and recipients.Then we discussed whether replacement blood donation would really meet the spirit of non-remunerated voluntary blood donation.Finally we made some legislation proposals,and when the“blood donation law” subject to edit in the future,our thesis work could provide some reference to determine how to edit the replacement blood donation related clauses.
