Research On Legal Problems Of Delay Retirement

With the aggravation of population aging in most countries and regions of the world,the internal industrial structure and employment structure have changed quietly,the labor force is scarce,the pension insurance fund security is facing tremendous pressure,the relevant laws are missing,the system is not yet complete.As a social problem of universal concern in the world,the postponement of retirement has always been an academic circle.Focus of attention.At the press conference of the two sessions in 2015,the head of the Ministry of Human Resources and Social Security said that a specific plan for postponing retirement would be formally launched in 2017.Now the plan is still in the stage of study and discussion,which shows that postponing retirement in the country is still not the best time to implement.The Third Plenary Session of the eighteenth Central Committee of the Communist Party of China made a decision on the reform of the social security fund,pointing out the implementation plan of postponing retirement in 2020.Delayed retirement has become a worldwide topic.Based on China's reality,this paper discusses the development and changes of the legal system of delayed retirement in the world and the current situation of China from five parts,drawing on the Constitution and successful experience of several typical developed countries,such as the United States,Europe,Germany,Britain and East Asia,Japan and so on.And the advanced experience of developed countries,designed to provide a useful reference for the reform of China's deferred retirement legal system.The first part is the introduction,which puts forward the legal problems of postponing retirement from four aspects: the world process of aging,the situation faced by our country,the present situation of our country's retirement system and the influence of other aspects;the second part is the current situation of our country's retirement legal system,respectively,from the changes of administrative regulations and the development of relevant departmental laws.The third part is the reference of the legal system of delayed retirement in developed countries.Taking the United States,Germany,Britain and Japan as examples,the paper respectively discusses the experience and methods of the legal system reform adopted by several typical developed countries in the face of population aging as a reference for the legal system reform of delayed retirement in China.In order to improve the legal system of deferred retirement in China,this paper discusses the feasibility of establishing and perfecting the legal department of social security,deepening the reform of the old-age insurance system and related auxiliary measures in the light of China's national conditions,with a view to serving as a reference for the reform of the legal system of deferred retirement in China.The current situation,problems and directions of the legal issues of delaying retirement in China are put forward.
