The Regulation Of The Autonomous Weapon System Under The International Law

From the stone age to the modern society,human weapons developed from simple sword to the long-range missile,the character of the precision and lethality was improved largely.There is a kind of weapon system which is different from the traditional weapons,that was integrated by a series of devices,including inductors that can ‘sense' some physical parameters like temperature,humidity and pressure.It is also equipped with analytical ability,so the weapon system can analysis all the physical parameters.As long as the fast development of the artificial intelligent(AI),the weapon system equipped with AI can react autonomously.They can select and attack the target without the intervention of human soldiers.This weapon system was so called “ autonamous weapon system”(hereinafter referred as AWS),which means that could detect and select the target and fire on it without any intervention of human being in the engagement.The International Law has strict restrictions on the “Weapon,the modes and means of operation”,so it is important to properly classify the AWS.The quality of“autonomy” differentiate it with the traditional weapon.And it is just between the“weapon” and “soldier”,the main current consider that it is belong to the conception of “weapon”,while other scholar consider it as “robot soldier”.The US defense department has found a new conception of “weapon system” to introduce the AWS,no matter how to classify the AWS,it shall always be regulated by the International Law.Another problem is the whether the AWS is legal weapon or not.Some scholars consider that the inherent requirement of the “discrimination principle” and“proportion principle” is the qualitative analyze,which the AWS is not competent,however other scholars have had an opposite opinion,they consider the future development of technology will solve this problem,and consider the advantages of the AWS,it may comply the International Law better than human being.The companying problem is the related responsibility.It is unreasonable to blame the AWS.And we shall talk about is from personal and national perspective.Considering of the fast development of the AI technology,and it is necessary to regulate the AWS before it has been launched.
