| This paper discusses the autonomous weapon system of the emerging weapon platform,the impact of its development on international law is mainly reflected in three aspects: first,the characteristics of artificial intelligence make weapon systems less and less under human control when making decisions;Second,the development of autonomous weapons systems has impacted on the principles of distinction,proportionality,prevention,and the Martens Clause,which are the core principles of international humanitarian law,and third,the attribution of responsibility for weapons systems,because the machine cannot take the responsibility for war on behalf of human beings,it is easy to cause the difficulty of accountability.With the development of autonomous weapons systems already unstoppable,the international community urgently needs to strike a balance between military necessity and humanity,guided by the principle of meaningful human control,on the one hand,the establishment of domestic legal review mechanisms for new weapons;on the other hand,the establishment of the development and deployment of autonomous weapons systems in violation of the International Humanitarian Law’s national responsibility system and individual international criminal responsibility accountability framework. |
