Research On The Legalization Of Auxiliary Police System In China

China is currently undergoing a period of social transformation.The reform of the economic system is deepening,social discord,insecurity and uncertainty are increasing,and the situation of public security is complicated.In this situation,the police resources are unable to meet the demand of reality.In order to alleviate the situation,the public security organs of our country publicize the auxiliary police officers,establish auxiliary police force,and then make up for the shortage of police.In recent years,as the number of auxiliary police has increased and the ranks have grown,auxiliary police have become a decisive force in maintaining social order.However,due to our country's lag in the legislation of auxiliary police and the lack of regulations,the auxiliary police are not responsible for the development process and the lack of legal guarantee.As a new mode of social governance,auxiliary police inevitably has new contradictions and problems in practice.In the face of this has been exposed to the institutional defects,not blindly enlarge so that questioned the necessity of the auxiliary police,also cannot ignore auxiliary police development situation,but because of the attention at the same time to analyze problems,find countermeasures.This paper starts from the social development of auxiliary police,analyzes the current situation and existing problems of the auxiliary police system in practice,andfinally discusses the development countermeasures of auxiliary police system.On the structure,apart from the introduction,there are four parts.The first part is the historical development of our auxiliary police system.The development of auxiliary police in China is mainly divided into three stages: the first stage is the public security team.In the end of the 20 th century,the public security team,which was produced in the end of the 20 th century,had some contact with the auxiliary police in the form of recruitment,terms of reference and responsibilities,so it could be regarded as the predecessor of the development of auxiliary police in China.The second phase is the transition period.The public security team has been retired due to lack of regularization and standardized management,but some areas will be flexible in their work,and the police will be compiled as auxiliary police.At this point,auxiliary police development enters the transition period.The third stage is the modern auxiliary police,which is the subject of this paper.The second part is the empirical study on the development of auxiliary police in China--taking the N district of huzhou city as an example.In January 2018,the author went to the public security bureau of the city of huzhou to conduct an empirical investigation to understand the development status of auxiliary police in the N district.In recent years,with the vigorous development of tourism,the area has been plagued by insufficient police force in traffic management and social security.The demand for police has increased.Therefore,under the influence of these social background,auxiliary police stepped into the official development track.In addition,according to the author's research,N district auxiliary police have the following characteristics: the auxiliary police force,the team is younger,the post distribution centralized service class,the service part is inclined to the base;In terms of the management system,the system of promotion is based on clear management,specialization of management mechanism,implementation of the certification system and promotion of natural promotion and preferential promotion.In terms of terms of reference,the respective terms of reference of the civilian auxiliary police and service auxiliary police are clarified and the work contents prohibited by the auxiliary police are specified.The third part is the development of auxiliary police in China.This part focuses on the problems arising in the practice of auxiliary police and the shortcomings of the auxiliary police system.It includes three aspects: first,the professional degree of auxiliary police is not high.From the basic situation of the auxiliary police force in China,the level of team culture is low,which affects the mastery of professional skills to some extent.The loss of the auxiliary police force is serious and the stability is bad,which is not conducive to the long-term development of the auxiliary police profession.And the training mechanism is vague and leads to low training efficiency.Second,the mandate of auxiliary police is not clear.There has always been a controversy about the source of the auxiliary police in the academic circle,and there is a lack of procedural rules in the legislation for the functions and powers of auxiliary police,so there is a lack of rules in both theory and law.However,in reality,the actual law enforcement phenomenon of auxiliary police is widespread,especially in the case of the fact that auxiliary police are highly controversial,which undoubtedly brings the auxiliary police to the forefront of public opinion.Thirdly,there is insufficient legal guarantee for the functions of auxiliary police.The lag of the legislation on the protection of authority,coupled with the fact that the auxiliary police have been confronted with violent attacks,has caused the relief of auxiliary police to get into trouble.In addition,the auxiliary police generally have the problem of different compensation standards and low welfare benefits.The fourth part is the countermeasure of Chinese auxiliary police system.Face the problem of the third part points out,should reflect on their own development and at the same time learn from the successful experience of other countries and regions and auxiliary police development,coupled with our social reality,explore the countermeasures to promote the development of the auxiliary police under the rule of law in our country.This paper gives the countermeasures of around improve the auxiliary police system in our country modern auxiliary police the basis of theory,establish a complete auxiliary police legal norms,clear authority and draw power scope,standardized management in order to promote auxiliary police team construction from four aspects,including key learning some from Germany,and ourcountry Hong Kong area.The above contents are the basic structure and main points of this paper.
