Research On Law Enforcement Efficiency Of Guangzhou City Management On Illegal Construction

Urban management is the main force to treat illegal construction.Every year,a large amount of human and material resources must be invested.Every year,new illegal construction is added.The old illegal construction has not yet been dealt with in a timely manner and gradually accumulates.It seems that the city management can not complete the task.Therefore,how to curb the number of new illegal construction,at the same time,how to improve the efficiency of urban management law enforcement in investigating illegal construction,fundamentally solve the problem of illegal construction is the old problem of urban governance.In this paper,literature analysis,data analysis and other methods are used to investigate and study.The concepts of opportunity cost is used to analyze the cost of illegal construction and the concepts of opportunity benefit is used to analyze the benefit of enforcement,based on the theory of cost-benefit,analyzes the effect of the difference between cost and benefit on the illegal subjects and enforcement subjects.First of all,Firstly,the paper introduces the achievements of Guangzhou city government in law enforcement construction in recent years,points out that the pressure is still severe,and reviews the policies and regulations of Guangzhou municipal government in law enforcement.Study the mechanism of illegal construction in Guangzhou.The third part focuses on the motivation that individual and organization break the law,and analyzes how to directly influence the thinking of individual and organization to commit illegal act.And decomposes the cost composition of illegal construction,the income structure,analyzes investigation probability of illegal construction,and the gross interest rate,obtains the difference of the illegal construction cost is less than the benefit.The fourth and fifth part analyzes how the law enforcement method restricts the law enforcement efficiency: the weak stickiness between complaint satisfaction and law enforcement efficiency makes the counteraction of complaint satisfaction decrease law enforcement efficiency.The members of Wenshi group adopt utilitarian law enforcement method to cater to their own interests.And further analyzes the motive of Wenshi group officers.analyze the factors that lead to the weak subjective initiative of Wenshi group members.Analyzes and compares the difference between the cost and benefit of law enforcement between Wenshi group and Lumian group,causes the unbalanced psychology of the group members and affects the enforcement efficiency.Law enforcement efficiency is low.The sixth part is that countermeasures to improve the efficiency of treatment of illegal construction are dynamic calculation of punishment cost and freezing of property rights.Ultimately,the costs outweigh the benefits,containing the source.Streamlining the law enforcement procedures,reducing the workload and the degree of difficulty and accountability,implementing a rotation mechanism so that the differences between the costs and benefits of the two posts slowly converge,improve the efficiency of law enforcement.Such a two-pronged approach can both cure the symptoms.
