Research On The Legal Mechanism Of Circular Economy In Qinghai Province

The ecological civilization has reached a new height in The Nineteenth National Congress of the Communist Party of China,emphasizing the establishment of a legal system for green production and green consumption and the construction of a green low-carbon circular economy system.As an integral part of ecological civilization,circular economy needs the support of relevant legal systems.Through the formulation of specific behavioral norms,the use of national coercive power to effectively guarantee and promote the development and operation of the circular economy.The paper investigates and analyzes the development status of circular economy in Qinghai Province,taking the circular economy experimental park as an example,and summarizes the circulation economic development of Qinghai Province's Qaidam Circular Economy Experimental Zone and Xining Economic and Technological Development Zone.Economic development constraints and major issues.Considering the fragility of ecological environment in Qinghai Province,the extensive nature of resource development and the lag of green development,the paper analyzes the shortcomings of the legal mechanism at the national level and the local legislative level in Qinghai Province at present,such as: the legislative orientation at the national level is not clear,the circular economy law The system is not perfect and producer responsibility is not effectively regulated.Qinghai Province's circular economy has no local legislation,policy formulation has not considered regional and industrial differences,and technical funding support policies are relatively backward.Qinghai province as an important ecological strategic area in China,circular economy is the key direction of economic development in Qinghai Province in the future.Drawing on the present situation of circular economy legislation at home and abroad,this paper puts forward some suggestions on the perfection of circular economy legislation from the national level and the local legislation level of Correctly handle the relationship with other departmental laws,improve the government's green procurement system,and improve the system of extension of producer responsibility.To formulate the regulations on the promotion of circular economy in Qinghai province;to improve the differentiated regional industrial policies;to formulate preferential policies to support the development of circular economy;to construct a technicalsupport system for circular economy;and to improve the evaluation index system of circular economy.In order to improve the legal mechanism of circular economy in Qinghai province,better develop circular economy,and realize the coordinated promotion of economic development and environmental protection in Qinghai province.
