Investigation And Reflection On The Current Situation Of Legal Aid For Drug Addicts Under Compulsory Isolation

In recent years,it has been a hot issue in the field of China’s legal aid to provide the disadvantaged group with legal aid services.On June 24 th,2015,the print and distribution of Opinions of the Improvement of the Legal Aid System conduct a full deployment of the further strengthening of legal aid services and improvement of the legal aid system,as well as points out the direction for the reform and development of legal aid services in the new circumstances.China’s legal aid system has developed from the original “going to court on behalf of disadvantaged groups for free” to the “Noah’s ark” of disadvantaged groups.In 2007,after the introduction of Anti-Drug Law,compulsory isolation for drug rehabilitation has become one of the three measures in the drug rehabilitation system.With a growing number of drug addicts,the group of persons receiving treatment of drug addiction increases as well.As a special type of the disadvantaged groups,persons receiving treatment of drug addiction lose their liberty to some extent.However,as a citizen,their rights are not deprived of.They are in need of legal aid services when faced with various legal issues.This article,starting from the legal aid status of persons receiving treatment of drug addiction in Guangzhou City,puts forward preliminary thoughts and exploration of the issue of “the legal aid of persons receiving treatment of drug addiction”.It is hoped that the theoretical research of China could be enriched,the requirement of China’s drug control and the comprehensive carrying forward of the rule of law could be met,and national security as well as the stability of social public order could be better maintained.This article conducts the discussion from the following four parts.The first part is “an overview of the legal aid of compulsory isolation for drug rehabilitation”.This part,based on clarifying the definitions of compulsory isolation for drug rehabilitation and legal aid,primarily explains the necessity of legal aid services of compulsory isolation for drug rehabilitation.Keywords: compulsory isolation,legal aid,rights,protectionThe second part is “the legal aid status of persons receiving treatment of drug addiction in Guangzhou City”.This part mainly introduces the legal aid status quo of compulsory isolated detoxification center in Guangzhou City.The third part is “analysis of the existing problems of the legal aid of persons receiving treatment of drug addiction”.This part,from the perspective of law and practice,conducts an analysis of the difficulties and causes of the application of legal aid service in compulsory isolated detoxification centers.The fourth part is “suggestions concerning the improvement of legal aid services of compulsory isolation for drug rehabilitation”.In this part,suggestions are put forward in terms of the improvement of the legal aid service of compulsory isolation for drug rehabilitation,including laws and regulations,rehabilitation center institutions,monitoring mechanisms,etc.The conclusion part indicates that it is inadequate to rely solely on rehabilitation centers to conduct the legal aid of persons receiving treatment of drug addiction.The most fundamental measure is determining the position and implementation of the legal aid of persons receiving treatment of drug addiction through legislation.It requires the establishment of a set of complete,unified and effective social policy mechanisms.The lawful rights and interests of persons receiving treatment of drug addiction are in need of further protection,so that the objective of safeguarding social equity and justice could be finally realized.
