Research On Anti-commercial Bribery From The Practice Of Industrial And Commercial Administration

Since The 18 th National Congress of the CPC,the new party and government leaders attach great importance to the fight against corruption and governance,and this work has been deep into all areas of society.Among them,the strict management of commercial bribery is an important part of the fight against corruption and governance.Commercial bribery seriously violate the basic principles of socialist market economy,the destruction of order,impede fair competition and rational allocation of resources,affect the investment environment;increase the operating costs of enterprises,resulting in the reduction of state tax revenue and misappropriation of public property;opened convenient door for the fake and shoddy,direct damage to the legitimate rights and interests of consumers,caused a lot of public emergency eventsand other social problems,become a hotbed of corruption and economic crime.However,due to China's commercial bribery of the main regulation of the "Anti Unfair Competition Law" implemented in 1993,by the legislative background limit,the content and the current business model change rapidly and transactions,there is a certain lag.At the same time,at present,all kinds of commercial bribery research focus on the field of macro,moral,corporate governance and the field of government management.Therefore,based on the concept,characteristics of commercial bribery,based on the analysis of the real harm,combined with the author's understanding in the experience of the business sector and the law,the existing in the investigation of commercial bribery in the jurisdiction,income and other aspects of the behavior of the dispute,the author puts forward his own views on how to further strengthen the governance of commercial bribery suggestions,hoping to provide useful help to curb commercial bribery.
