Research On The Third Party Access To Gas Pipelines In China

Along with the United States,"shale gas revolution",China's huge shale gas reserves and the advantages of natural gas as a high-quality clean energy advantages,making the natural gas industry's prosperity and development of China's energy revolution righteous.The third party access system is introduced into the pipeline network connecting the upstream and downstream links of the natural gas industry so that the natural gas suppliers and users can directly deal with the pipeline transportation services provided by the pipeline operators and the importance of the marketization of the natural gas industry is obvious.This paper analyzes the third party access system of natural gas pipeline network from two aspects: natural monopoly and compulsory contracting theory.Then,the paper analyzes the main problems existing in the third party access system of China's natural gas pipeline network: China is still in the three major oil companies integrated monopoly state,separate operating system is not fully implemented,pipe network independence is difficult to achieve;upstream open system is imperfect,Due to the existence of the principle of "first application",the block exit mechanism,the formation of public information on the formation of information provisions are not implemented,Which leads to the lack of main security to the third party access;legal liability is not clear,which brings obstacles to the consultation mode;The problem of lacking independent regulatory supervision and effective supervision and so on,results in the lack of protection of the program running well.In this paper,through the study of the evolution history and characteristics of the third party access system of natural gas pipeline network in Europe and the United States,combined with the main problems existing in our country,it is suggested to adopt differentiated policies,sub-regions,learn from the experience of EU pipe network access reform,From financial independence to legal person independence,then complete the property independence finally,accomplish the pipe network independence step by step;Use the filing system,release the pre-admissionprocedures,achieve the block exit mechanism and protect the fair access of third parties providing the main security;Clear the liability of regulatory authority and the relevant enterprises,especially the network management enterprises;it is recommended to improve the supervision of the legal system,improve the independent regulatory agencies,optimize the regulatory tools to achieve authoritative and efficient supervision and ensure the normal operation of third-party access procedures.
