A Preliminary Study On The Protection Of Human Rights In Public Security Punishment

In our country,public security organs shoulder the important task of maintaining social stability and ensuring stable economic and social development.With the development of the times,public security administrative law enforcement is becoming more standardized and scientific.How to properly handle the relationship with the protection of the rights of the administrative counterpart in the daily law enforcement process is a problem that must be continuously concerned in the law enforcement of public security.It is of great theoretical and practical significance to explore the protection of human rights in the management and punishment of public security in China for strengthening the protection of human rights in the administrative law enforcement of public security.In addition to the introduction and concluding remarks,this article is divided into four parts,focusing on public security management punishment and human rights protection.The first part: Punishment right and human rights protection of public security management.This part first elaborates the meaning of human rights protection,briefly describes the development of human rights protection and the current situation of human rights cause in China.Secondly,through the embodiment of human rights protection in the punishment of public security management,the ultimate goal of human rights protection in the punishment of public security management is to maintain public order and ultimately safeguard the legitimate rights and interests of citizens.Then it makes a theoretical analysis of human rights protection and public security management punishment,and concludes that they promote each other.Public security organs take the effective protection of human rights as the highest working goal,and the protection of human rights and public security management punishment can be highly consistent.The second part: The lack of human rights protection in the current public security management punishment in China and the analysis of its causes.This part mainly elaborates the realization of the lack of human rights protection and the existing procedural deficiencies in the current public security organs' punishment of public security management,and simply analyses the reasons for the lack by enumerating.The third part: the investigation of the punishment system in Taiwan and other countries.Through understanding the penalty system of the country,Germany,Anglo-American law system and Taiwan region of our country,combined with the different penalties of public security management in our country,we can learn from them.Part ?: Measures to improve human rights protection in public security management punishment.In this part,according to the first three parts and the actual situation of public security management punishment in China,the author puts forward solutions to improve human rights protection in public security management punishment.
