A Study Of Administrative Regulations On Fire Safety Risks

Fire safety is an important part of the government's social management and public services and it is also an important guarantee for social stability and economic development.The legal regulation of social risks in modern legal state is an significant component of the government duties.In particular,the regulations of administrative provide a sufficient evidence and guarantee for the activities of social risk regulation.This paper is used the research of comparison,history,literature and normative comprehensively,from the background analysis of the risk society.It is tried to explore how to further improve China's administrative regulations on fire safety risks under the framework of risk management,taking the administrative regulations of fire safety risks as the object of discussion.This paper is titled as “A Study of Administrative Regulations on Fire Safety Risks” and separated into four chapters:In the first chapter,the author starts from the concept of “risk”,which intends to introduce the basic theory of risk regulation,so that readers can have a certain understanding of the background knowledge of fire safety risk administrative regulations.In chapter two,according to the discussion of the concept of “fire hazards” under the legal context,which relating to the fire-protection engineering,the author gains the concept of “fire safety”.And then combining with the “risk” of concept mentioned in the first chapter a concept of “fire safety risk” is gained.Considering the fire work practice and people's general understanding of the characteristics of the fire itself,the understanding of the features of fire safety risks was analyzed and summarized.Chapter three illustrates the relationship between the risk regulation and public power,the theoretical model of risk regulation as well as the legalization of the risk regulation,etc.It is also analyzed the relationship of risk regulation and the administrative law as well as the challenges between these two issues.In terms of the former discussion,the author summarizes the reasons why fire safety risk need to be bound by the administrative law and offers the further discussion of the concept of “Administrative regulations on fire safety risks” combined with the former content.In the last chapter,combining with the exploring the administrative practice of the fire safety,it is carried out from five aspects: the research of basic theory,the principle of regulation,the normative system of regulation,the system of power and responsibility of regulation,and the social intermediary organization of regulation.According to the previous discussion about the basic theory of risk administration,the author is trying to put forward ideas and suggestions for the administrative regulations of fire safety risk in China.
