The vigorous development of the sharing economy has provided a powerful boost to the steady progress of China's market economy.The sharing of social idle resources has greatly improved resource utilization.However,rapid development is a double-edged sword,and the common problems such as the blank of law and the urgent need to establish a social credit system exist.The sharing economy platform penetrates rapidly and participates extensively in the consumer sector.However,the lack of government supervision caused by the unclear platform positioning,the lack of self-discipline in the industry,and the problems of monopolistic and unfair competition frequently appear.These problems have made it difficult for consumers to protect their rights and interests.For example,the hidden dangers of personal property security rights,the challenges faced by the right to know,the vulnerability of information security rights,and the difficulty of obtaining claims are difficult to achieve.At present,the issue of consumer rights protection in the sharing economy is weak in China's legal theory.There is no systematic and complete academic research on the topic of improving the sharing economy from the perspective of consumer rights.In particular,research on the issue of legal regulation in new areas of the sharing economy is even rare.The speed of renewal of the sharing economy has far exceeded the speed of theoretical development.Therefore,this dissertation explores the current situation of China's shared economic development and introduces case reviews to explore the problems and causes in the existing shared economic regulation structure.From the perspective of consumer rights protection,the thesis proposes a regulatory strategy that is suitable for China's actual situation.The purpose of the research is to improve the construction of the consumer legal protection system in China's current sharing economy and further enrich China's economic law theory.This research also hopes to provide institutional guarantees for protecting the legitimate rights and interests of consumers,exploring a benign mechanism for sharing economic development,promoting the smooth advancement of supply-side reforms,and comprehensive economic and social progress.This dissertation mainly discusses the protection of consumer rights in the sharing economy from the following five parts.The first chapter is the introduction.Explain the background and significance of research on the protection of the legitimate rights and interests of Chinese consumers in the sharing economy.The innovation,research methods and general framework of this paper are introduced.The second chapter is the legislativeization of the sharing economy.After introducing the basic connotation of the sharing economy,detailed analysis of the status quo of China's sharing economy,Analysis of the theoretical research status of the sharing economic laws and regulations in China and abroad.At the same time,combining the reality,it outlines the legislation of sharing economy at home and abroad,and lays a foundation for the next step of research on the direction of specific consumer rights protection.The third chapter analyzes the chaos in various fields of China's sharing economy,points out the risks and harms brought by consumers to the right to security,the right to know and the right to claim,and explains the legal reasons for frequent violations in reality.Propose the corresponding solution to provide ideas.The fourth chapter is the construction of China's consumer rights protection system under the shared economy.Firstly,it proposes the system from the four perspectives of establishing the legal framework of consumer rights protection under the shared economy,the collaborative protection supervision system,the unified credit interconnection system and the perfect insurance system.Reasonable and reasonable suggestions,and then through the further improvement of judicial remedies and other non-legal protection mechanisms,to establish a relatively complete consumer rights protection system under the shared economy.
