A Study On The Safety Legislative Regulation Of Autonomic Vehicles

As a result of the combination of artificial intelligence and Internet technology,autonomous vehicle(self-driving car)not only has broad opportunities,but also challenges existing laws with potential safety hazards.Up to now,there have been a number of accidents involving self-driving cars.For example,gao mou drove a tesla smart car into a parked vehicle on the beijing-hong kong-macao expressway in October 2016,and the driver was killed on the spot.Similarly,Joshua died at the scene of a traffic accident while driving a tesla smart car on the Florida highway on May 7,2016.March 18,2018 in Arizona,USA,an Uber self-driving car crashed during a test and caused the death of a woman,among other things.The technology of self-driving cars is not yet mature,so it is irresponsible for consumers to blindly go to the market so early,which to some extent makes the public question the safety of self-driving cars.The United States,Germany,the United Kingdom and other countries are leading the way,and have introduced laws and regulations in line with the development of self-driving cars.On the contrary,the relevant legislation of self-driving cars in China has obvious hysteresis,and it still stays at the level of departmental regulations and normative documents.Among many problems,the technical safety evaluation standard of self-driving cars,information network security risk,privacy and personal information protection,civil liability recognition and automobile insurance innovation are particularly important.This paper attempts to regulate the technical and information network security risks caused by self-driving cars through legislation to ensure road traffic safety.At present,the academia has not paid enough attention to the impact of the safety risk of self-driving cars on the existing legal system.In this regard,the author hopes that the research on relevant issues can arouse more scholars to discuss the legislation of self-driving cars,so as to promote the standardized development of self-driving cars.This article from the concept of self-driving cars,basic principle and the security risks of existence,which leads to the self-driving car safety risk challenge to the current law,think self-driving cars to regulate to the most basic human value-"safe" as the core,the security technology security,privacy and security of network information security,algorithm caused by ethics.Then on the investigation to the extraterritorial legislation,and summarizes the self-driving cars to regulate the main content of the involved,including outside self-driving cars safety standards,self-driving cars network security prevention and solution of personal information protection,automatic driving the rules of tort liability allocation and insurance innovation,self-driving cars algorithm ethical regulation.The third chapter,in response to the safety risks of self-driving cars and their legal challenges,combined with the enlightenment of foreign legislation,puts forward Suggestions to improve the legislation and regulation of self-driving cars in China.The main content of this paper is divided into three chapters:Chapter one analyzes the concept,characteristics,intelligent classification of self-driving cars and the challenges brought by the safety risks to the current legal system.Section 1 definition of self-driving cars mainly covers the concept,features and intelligent classification of self-driving cars.The first part of the second section discusses the safety risks of driving vehicles,including technical security,network security,personal information privacy protection security and algorithm ethical risk.The second part of this section deeply analyzes the legal issues arising from the risks of self-driving cars.The second chapter studies the current situation and content of foreign safety legislation and regulation of self-driving cars,and on this basis summarizes the main content and enlightenment of foreign safety legislation and regulation of self-driving cars.The first section introduces the status quo of legislation and regulation of self-driving cars outside the region,especially the relevant legislation of self-driving cars in the United States,Germany and Britain.In the second quarter in the previous section,on the basis of summarizing foreign security risks in response to self-driving cars and taken to regulate the main content and evaluation,including: automatic driving technology security standards,network information security and privacy protection rules,the innovation of distribution of tort liability and insurance system and ethical rules related legislation.In order to respond to the safety risks and legal challenges of self-driving cars in chapter 1,combined with the analysis of overseas legislation in chapter 2,chapter 3 puts forward Suggestions on legislation and regulation of self-driving cars in China.The first section firstly,self-driving cars to regulate value in jurisprudential self-driving cars on the road of involving safety,freedom and order value,the article analyzes the value and multiple value target for the center with safety are obtained,the second section discusses the self-driving cars legislative principles and legislative model selection problem.The third section discusses the main contents of the legislation and regulation of self-driving cars,respectively reviewing and revising the road traffic safety law.Explore the establishment of automatic driving security system from three aspects: technical security,privacy and data security,and network security construction;This paper analyzes and demonstrates the civil liability and insurance rules of autonomous driving,and finally proposes to explore the ethical regulation rules of autonomous driving vehicle algorithm.
