National parks are a way to resolve the conflict between effective conservation and rational use of natural resources.National park planning legal system is an access to guide national park construction,management,development a nd a series of process of the normative documents.Vertically,it consists of five levels: development plan,master plan,special plan,detailed plan and annual work plan.Horizontally,it consists of four parts: planning preparation system,planning appro val system,planning implementation system and planning supervision system.Great achievements have been made in the planning of national park system since the pilot work was carried out.The promulgation of the Sanjiangyuan National Park Master Plan has realized the transformation of China's national park planning laws from scratch.However,the primary problem brought about by this is that in the case of the lack of system planning,the pilot areas of the region have introduced the master plan of the region,which is a matter of putting the cart before the horse.At a time when the pilot work is about to come to an end and the national park system is about to be formally established,it is imperative to introduce a macro-level development plan.In addition,due to late start and inexperience,China's national park planning legal system is not mature enough.There are still many problems that need to be improved.It is necessary to learn from the experience in the legal system of the National Park of United States,Germany,and Japan.We need to learn the planning concepts of their protection,to lead the development of the planning system by the legal system,and to pay attention to the importance of public participation.In learning and learning,we will le arn from each other's strengths and constantly improve the national park planning legal system.In the planning preparation system,it is necessary to give full play to the functions of the newly established National Park Planning and Research Center in China,and use the law as a guide to the content of planning,and gradually refine the procedures for planning and preparation.In the planning approval system,it is necessary to clarify the unified review and approval body and strictly follow the planning approval process.Focus on reviewing the principles and objectives of the program,legal compliance,and interfacing with other types of planning.In the planning implementation system,in order to unify the implementation standards of the plan,it is necessary to gradually rationalize the relationship between the national park and the former nature reserve.Then,strengthen the financial guarantee for the implementation of the plan and follow up the assessment of the plan in a timely manner.In the planning supervision system,the Ministry of Ecology and Environment is designated as the supervisory body of the plan,and the planning and inspection system,the work report system and the assessment and punishment system are gradually improved.Expand public external supervision and let the public participate in the implementation.
