Research On Problems And Countermeasures Of Anti-Domestic Violence Law

The Anti-Domestic Violence Law of the People’s Republic of China promulgated in 2016(hereinafter referred to as the Anti-Domestic Violence Law)is the first national legislation on anti-domestic violence in China.It is also the first time for China to determine in the name of the state that "domestic violence" is no longer a household affair.Domestic violence is an illegal or even criminal act,and it is the state’s family in order to maintain equality,harmony and civilization Relations are important laws enacted to promote family harmony and social stability.The primary purpose of legislation is to prevent domestic violence and stifle it in its infancy;the second is to punish the perpetrators of domestic violence.Combination of prevention and treatment in order to better intervene in domestic violence.After the promulgation of the Anti-Domestic Violence Law,in order to better achieve the legislative objectives,various organs have done a lot of work.But now the law has been implemented for three years,and some problems have been exposed in practice.Some of these problems are the problems of the law itself,and others are the problems in the implementation of the law.This paper mainly analyses the problems encountered in the implementation of the Anti-Domestic Violence Law and gives some suggestions in order to benefit the innovation and development of the Anti-Domestic Violence Law system.
