"Anti-Domestic Violence Law" In The Perspective Of Lhasa's Domestic Violence Prevention Countermeasures

Family is the fundamental unit of society.Domestic violence is a severe problem that disturbs both family and social harmony.It also violates the legitimate rights of family members,which affects family harmony and social stability.The Anti-Domestic Violence Law of the People's Republic of China was promulgated on March 1.2016,which reflects the progress China has made in the rule of law.However,some content of the Anti-Domestic Violence Law of the People's Republic of China,without an effective prevention mechanism,remains theoretical.The settlement of domestic violence still needs more efforts.Beginning with Lhasa's domestic violence,this paper takes the male-on-female domestic violence for instance to discuss the prevention of domestic violence.Through the analysis of data gained from interview and charts,the paper explores and analyses existing problems on the prevention of Lhasa's domestic violence;finally it puts forward legal countermeasures against the domestic violence.Besides,the author hopes that all parts of society could work for cooperation to prevent the domestic violence and make it practical.This paper is divided into five chapters.Chapter I This part mainly talks about the questions triggered by domestic violence,its research background,significance,and analyses of domestic and foreign prevention measures on it.Besides,it also draws experience from the laws and judicial practice of Britain,America,Norway and Canada,and the successful experience of Guangxi,Hongkon,Liaoning,Hunan and Taiwan,which are helpful for our learning.Chapter This part explains the definition of domestic violence.It ?discusses reasons,characteristics and harm of domestic violence.Chapter ?With the Anti-Domestic Violence Law,this part mainly talks about the current situation of Lhasa's domestic violence and does the relative research.It also analyses the features and causes of Lhasa's domestic violence on the basis of tables and data.The domestic violence in Lhasa is caused by both the traditional culture in which women are given low status,and plateau's unique marriage model.Moreover,because of the lack of government intervention on petty domestic violence,the costs of breaking law is low,resulting in the increasing number of domestic violence events.Chapter ?This part talks about the present anti-domestic violence law and its shortcomings.Chapter?Based on the characteristics of Lhasa's current domestic violence and the relative laws as well as practice from home and abroad,this part proposes some effective ways to perfect the relative laws,make the anti-domestic violence law systematic,improve the government intervention system,build a multi-level social assistance system by integrating social resources,establish a sound social security system,and strengthen legal advocacy.All these also are helpful to enhance people's sense of safeguarding their legal rights.With these practical measures,this paper aims to prevent the domestic violence and offer women more help,which is good for protecting women's legitimate rights and safeguarding social harmony.The author doesn't know Tibetan language.Therefore,the social survey was carried out in Chengguan District of Lhasa City rather than in surrounding villages.This paper mainly discusses the urban domestic violence instead of rural domestic violence.Cases involved in the paper happen among people living in the city.That is why the content is not comprehensive.
