Research On The Theory Of Street Bureaucratic Administrative Discretion Of Our Country In The Context Of The Powrt List System

China is a country ruled by law,the organs of State power exercise the legal power conferred by law according to law,and street bureaucrats,as the "window" of our government organ units dealing directly with the public,enjoy administrative discretion according to law,that is,the disposal power of certain choice within the range and scope permitted by laws and regulations.Administrative discretion is an important part of administrative power,if used properly,it will greatly enhance the administrative efficiency of the Government,on the contrary,if used improperly,it is easy to breed corruption and damage the image of the government.The Power list system put forward by the CPC Central Committee at the time of the eight third plenary in Beijing is a powerful constraint and regulation of the administrative power of our government,an important measure in line with the socialist system with Chinese characteristics,and provides a strong guarantee for standardizing the administrative discretion of the street bureaucrats.The implementation of the Power list system throughout the country is an important reform task issued by the CPC Central Committee and the State Council,an important measure to build the national governance system and improve the ability of modern governance,and is of great significance for the construction of administrative system reform,the standardization of the exercise of power by street bureaucrats,the optimization of the use of administrative discretion.Since the introduction of street bureaucrats into China's academic circles,has caused a wave of research,research conclusions are endless,but through the conclusion of the study is not difficult to find that many scholars ignore the street bureaucracy and citizens between the direct interaction.In this paper,under the background of carrying out the Power list system,drawing on the research results of Western countries,combining with the specific national conditions of our country at present,summing up the normative control of the administrative discretion of the street bureaucrats in China in the exercise of the scope supervision norms and the exercise of procedures since the introduction of the Power list system,This paper analyzes the manifestations and causes of the abnormal operation of the administrative discretion of the street bureaucrats,and concludes that due to the imperfection of laws and regulations,the low quality of street bureaucrats,the unsound supervision mechanism and the influence of the traditional customs of society,there are some abnormal manifestations such as abuse of power,unfair practice and administrative inaction.In view of the above problems,this paper,starting from the Power list system,puts forward some suggestions for better standardizing the administrative discretion of street bureaucrats,through perfecting the relevant laws,reasonably controlling the degree of my control,perfecting the diversified supervision mechanism,perfecting the relevant supporting facilities,and establishing the high quality street bureaucrats,so that they become the real window test,Service-type personnel and other measures to build a service-oriented government,modern government and efforts.
