Research On The Legal System Of Operational Stateowned Assets Management

State-owned assets are of great significance to China's socialist basic economic system.State-owned assets can be divided into operational state-owned assets,administrative enterprise-owned assets,and resource-state state-owned assets according to their attributes and roles.Among them,the management of operational state-owned assets is the most concerned.China's operating state-owned assets account for a large proportion of GDP and occupy an important position in the economy.The scientific construction of the operational state-owned asset management system is of strategic significance to economic development and is conducive to the realization of the preservation of state-owned assets.While affirming the basic framework of the current operational state-owned asset management system,this paper proposes the management of operational state-owned assets through longitudinal study of the lessons of the reform of the operational stateowned asset management system and horizontal comparison of foreign advanced theoties.Firstly,it analyzes the connotation of operational state-owned assets,and focuses on the value and function of the operational state-owned assets supervision law.On this basis,it discusses the evolution of China's operational state-owned assets management system,and analyzes China's operational state-owned assets.The status quo of management points out that the current problems in the management of state-owned assets in China are: imperfect state-owned assets supervision legal system,unclear ownership,political and enterprise,political and capital;Subsequently,the article expounds the practice and experience of the extraterritorial operating state-owned asset management system,and draws lessons from the improvement of China's operational state-owned asset management system.Finally,it proposes that China's operational state-owned asset management system should be gradually improved from four aspects: Improve the operational state-owned assets supervision system,enhance the supervision ability of the operational state-owned assets supervision department,strengthen the supervision of the credibility of intermediaries,and improve the corporate governance structure of stateowned enterprises.This paper hopes to provide a reference for establishing a sound operational state-owned asset management system and better realizing the preservation and appreciation of operating state-owned assets.
