Research On The Legal System Of Internet Credit Investigation

China’s credit investigation system started from the field of bank credit.After years of development,it has gradually formed a diversified pattern with the credit investigation system of the People’s Bank of China as the leading factor and the market-oriented credit investigation institutions as the supplement.In recent years,the concept of "Internet +" has springing up rapidly,which has had a tremendous impact on traditional industries,and the Internet credit industry has also emerged.At the same time,the State Council has put forward the call of "mass entrepreneurship and innovation".In order to encourage and support the development of Internet credit industry and accelerate the construction of social credit system,China has issued a series of related policies.The promulgation of this series of regulations means that China’s Internet credit industry is developing rapidly.Under the rapid development of Internet credit investigation,lots of problems have been exposed,such as the incomplete legal norms,imperfect industry mechanism,inadequate protection of information subjects’ rights,incomplete legal liability,etc.Because Internet credit investigation is still in its development stage,there are few studies of it in academia,and there is a lack of relevant theories on the legal system of Internet credit investigation.Therefore,this paper makes a series of studies on the legal system of Internet credit investigation,analyses the current situation of the development of Internet credit investigation,takes Zhima Credit,a typical representative of Internet credit investigation,as a case study,and analyses the legal characteristics and possible legal risks of it.On this basis,this paper puts forward the existing problems of the legal system of Internet credit investigation in China,and further examines the legal system of Internet credit investigation in the United States,draws inspiration from the comparative study.Finally,this paper puts forward the ways to improve the legal system of Internet credit investigation in China from the following aspects: establishing the legal system of Internet credit investigation,perfecting the mechanism of Internet credit investigation industry,strengthening the legal protection of information subjects’ rights,and perfecting the legal responsibility of Internet credit investigation.Hoping to make contributions to the construction of our social credit system.
